This is the headline:

COMPLAINT FILED AGAINST STEAM LOCOMOTIVE CONTRACTORS
McCreary County Heritage Foundation alleges breach of contract against Wasatch

The best I can sum up for now is that it seems the Foundation has filed a lawsuit because they alledge the contractors didn't meet the terms of the contract and that the K&T #14 is not FRA-compliant even though the work to restore it has been done.

The link is to a photo of a newspaper article; the article says the McCreary County Heritage Foundation, owner of K&T Railway #14, has filed a civil action against Wasatch Railroad Contractors.

I believe this is a topic avoided on RyPN because of the rancor involving commercial interests, including threats of legal action. That is sad, but RyPN isn't the press as such and has no ethical obligation to cover such stories.

I just hope that someday Morehead and North Fork Railroad can be represented by both 12 and 14 under steam. Both are worthy of restoration and continued fame of being some of the last steam engines used up until 1965 on the small shortline in Clearfiled.

Simple answer:

Commentary on this issue should be restricted to simply what OTHER parties have published.

Resist any temptation to spout either more attacks on said party or attacks in defense.

Any supposed/imagined "libel" thus falls strictly on the McCreary Voice, and not members or posters here.

Facts are important: As of this writing, Wasatch Railroad Contractors has not been served any notice of any pending legal action. This post (and similar on Facebook) is the first we have heard of any of this.

Second, if this is true we will be filing a counter-claim alleging failure to pay. It is true that WRC resigned from the project over a year ago on grounds of non-payment resulting in a breach of contract between parties.

Remember, there is always two sides to every story.

Well it IS literally news, and it is on a rail preservation topic so it is allowable. BUT if this devolves into making accusations the thread will be locked.

BTW, it is important that the Subject line describes the content of the thread. Someone scrolling through the subject lines should be able to discern the topic being discussed without clicking on the thread.

The title of this thread raises issues by itself....

We have a history on this board of two railroad contractors, one mentioned in the article warring...

Both, particularly the one mentored in the article are responsible legitimate contractors. Posts and accusations over this project have been the cause of some of the complaints. I note that the project seems to have been stalled for local reasons... not related to the work on the steam engine.

Please be careful about comments... If you are not involved you probably shouldn't post. The moderators are aware of this thread, and will take action if this gets out of hand...

Yes, this particular subject line gives NO idea of what is being discussed. I assumed it was a reference to hand firing a steamer as in a variation of "hand bomber" slang until I opened this thread up to learn it concerns apparent legal issues over a restoration project.

Subject line should list the what at a minimum, where would be good too if space permits. It would make skimming thru the threads go much smoother without having to resort to opening a thread to see what it's about. IMO this particular thread's subject line is a form of "click baiting". Sorry about the thread drift but it is related since the moderators made a point of bringing up the subject line content.

Presumably reporter Eugenia Jones, who has contact information in the story clip on Facebook that has been linked here, will be handling the 'followup' to this story, presumably including WRC's response once it has been developed.

It occurs to me that, as an approach far more useful than the usual kinds of veiled or Byzantine commentary here, we should write directly to her as the source and provide information, background, and such other details as will improve the level of coverage, and thence, hopefully, of discourse.

I wasn't surprised by the subject title given; though I will say that it accurately describes at least 3 other "taboo" subjects on RYPN that tend to get locked or deleted or booted over to railfanning every time a thread is created.
