Worth every penny you paid for this, take it with a grain of salt, and no complaining if you can't/won't Facebook, but MTO apparently has popped up on Facebook. I can NOT verify these folks are authentic, I also am not suggesting they are not.

In April 2007, I chartered a photo freight on the railroad, covering the entire railroad. We went from the museum south to Sutherland Avenue, north to Tipton, and back to the museum. We had fun with photos at the Nickel Plate Bar & Grill using the NKP loco and boxcar. The consist was south to north:

NKP 426 - loco
NKP 8099 - boxcar
CR 435140 - hopper
PRR 257784 - covered hopper
GRCX 3746 - tankcar
Wabash 17193 - auto box
Central Indiana - flat
NKP 770 - caboose
NKP 1 - business car
ITM 3099 - coach
ITM 3078 - coach
ITM power combine
Monon 50 - loco

Robert, you are correct. We had the schedule worked out in great detail until the day of the trip when another member suddenly changed the way the trip could operate. We did freight on the south end and then passenger only on the north end. We also had a 3-hour delay while there was some concern about a smoking locomotive (it hadn't been run in a while and it was simply stack soot), but we did a number of photo runbys and photo set-ups while waiting for mechanical people to show up. I found my minute-by-minute details of the trip, and someone sent me a reminder about me sleeping on the sidewalk during the delay. We had about 5 hours of total railroad-cause delay that day (we did photos whenever there was a delay), but we got some great photos that were in several of the hobby magazines. We also did a nice night photo session the night before in the snow.

On a sort of related note, the new Nickel Plate Express, purchased a set of former Amtrak, former Santa Fe, hylevel cars for use on the new tourist operation. Now I may not be a smart man, but I don't see how they can truck them in there they're already over height. I would think that they're going to have to put the connection back in.

If you still have equipment there, maybe it will be possible to work out a deal with the city of Noblesville, to wait until after the interchange is put in to get your stuff out.

Big if, they are going to do that.

They are trucking the equipment in at Tipton.

Thanks for the answer. I figured that would be pretty difficult due to the height of the cars, but where there is a will (and money) there is always a way!

I think we all saw this one coming:

https://www.ibj.com/articles/69511-prop ... mpensation

Now, what I'm still puzzled about is whether or not the federal rules still apply if the STB ruled that the line was legally abandoned way prior to the trails act and was under state jurisdiction (at least for service), or if because it was abandoned prior to the trails act and hit the state clause, is why it goes to federal settlement. Yet the STB said they still had jurisdiction to make this decision.

This still remains an odd situation given the reliance on "Common Carrier Status of States". That may affect service but not compensation.

Here's the decision to refresh your memory:
https://www.stb.gov/decisions/readingro ... enDocument

The only one I've seen blow up like this and go into federal compensation for landowners was the Port Royal "Beaufort Railroad", and in that one the local government had already put down a sewer/water line on the ROW and that was the basis for compensation back to the owners. And you'll see that one listed as precedent here.

A post on another forum claims that "the City has seized the bank assets of ITM so that there will be sufficient funds for environmental remediation of the former museum site."

The other forum requires a login, so I cannot directly link to the post I quoted. I also lack the legal expertise needed to locate relevant court order(s).
