By way of the example in this thread and in so many others there is an underlying theme of either \ or. Either you can or you cannot. No middle ground. No negotiation. No recognition of reasonable effort. This term of reasonable effort is found in nearly every AIA contract.

Many many of these disputes are based on one party or another acting in a preemptive manner with X,Y or Z being a critical assumption. Then there are critical assumptions made by. if you will, the opposing party.
All of this seems to be based on poor planning and then it's execution on either side.

I realize these observation are of a generalized nature. That being said, from my own experience executing construction projects in the two million dollar range, a successful project typically takes comparatively an enormous amount of time planning versus the work being done in process to completion. The successful projects in planning require a multidisciplinary approach to cross the t's and dot the i's. This cannot be done on a shoestring of time and effort or resources.

I wish I had a dollar for every example of unanticipated consequences I have read here.
