We're getting off track here, gentlemen......and I know we are better than this. Take it to the railfanning section.

Anybody have anything practical to add to the discussion about the new safety standards and our relationship with them?

I guess I am a litttle at a loss to understand the frenetic attempts in some quarters to dance around or circumvent the FRA regulations. Insular or not, the FRA regulations would be considered in a court of law as "best practices." If you are not following "best practices," then you do so at your own peril. Some people like taking those kinds of risks. I do not.

Mike

Can you provide a real-world example of this happening? In particular, I'm looking for an opinion by a court of law that determines that FRA standards are the one and only "best practices." Please provide the jurisdiction, the style of the case, cause number and judge or judges who wrote the opinion.

Again, FRA says that all of us are exempt from 238, in every medium in which they can communicate that fact.

Unless this has changed, 229 only applies to operations on the general system.

Ross, I would say no. Doxxing is serious business.

Foamers, you don't have the whole picture.

Dave, please don't lock a good thread, merely cut out the cancer. It won't return.

David: +1. But not holding my breath.

Its really late (or early, depending on your perspective) but I wanted to thank Robert for taking the time to answer my question(s) using examples back on page 2. If I take anything away from this exercise, it is simply that the FRA regulations shouldn't be taken in toto as necessarily applicable to any operation. They should be read and studied, and input from knowledgeable persons should always be sought. Further, the FRA shouldn't be looked at as "the enemy", but people with less that a full understanding of the regulations could very well be such! Thanks again! Time for bed...

Well, we're down to about 30 months to meet the requirement on alerters for diesel locomotives operating over 25 mph, which I'm sure excludes a lot on this group. However, I'm working on coming up with my implementation plan as we speak.

I have found one company who can offer an installation kit, but it includes a new event recorder and a lot of other things that I don't need to meet the requirement. Cost will be around $15,000 per locomotive, and thats only the electronics. I have to do the air side myself.

So, I'm looking at building my own system. We're still looking at cost of materials, but I expect I can do this a lot cheaper.
