dId any pieces get sold or given away yet?

The bids/proposals are due in today (April 30th). They aren't supposed to award any of the equipment until the middle of May.

Hmmm... an interesting question is why any of us would expect to be notified? Why?

Possibly because we'd then receive (or hear about) the e-mails, calls, letters, etc. asking for funds or other help in relocating certain pieces to their new homes?

Or, further, we'd hear the eruptions of rage from those who weren't privy to the latest round of memos if/when the scrappers parked outside said pieces and lit their torches?

Perhaps (just perhaps) they're raising cash in case the 952 court case goes against them?? That way they cou;ld satisfy the judgement (if they were to lose the case) without burdening the county for the money???

Just a thought!!

I had expressed an interest in the Porter fireless before the bid closing but did not have the opportunity to travel out for a first hand look. They were more than helpful and answered all my questions. On 15 May I asked them for an update on the Porter and they did respond indicating that no final decision had been made. I guess what I'm saying is that if you had an interest in a piece that they seem willing to provide an update.

Well Mr. Rowland, if you are anything, you are consistent in that you can't wait to get your "digs" in on an organization that doesn't operate the way you think it should. I doubt this is the "true" motive of the process is to covertly raise money in case the County looses the 952 lawsuit. Also, I believe the R&LHS suit is for possession of the locmotive. As such, I don't know what actual damages the R&LHS could claim. You've previously stated as "fact" on this forum that MOT is supposed to return the locomotive in operationg condition. A check of the pleadings for the case shows no such claims by R&LHS. Why don't you save us and stop the wild speculation and trolling?

As to the specifics of the upcoming trial over the 952 it was my understanding when I left (4 yrs. ago to move to Northern NY) active membership in the R&LHS chapter that is the plaintiff in the case, that part of their lawsuit was to enforce the terms of the original loan agreement which included the proviso that the MOT was to maintain the 952 in operating condition ( which it was in when loaned to them), reasonable wear&tear excepted??? If they've dropped that piece from their current bill of particulars I was not aware of it.

Let's hope for all concerned it gets tried soon and a verdict is finally reached. I'm sure that the legal costs have long since grown into 6 figures....what a shame!!!

There is ONE piece on the list that should be coming back to PA, but it is not a steam locomotive... it is the Lehigh Valley coach.

As far as I know, there hasn't been an organized effort to get her back. I had a few discussions with possible partners, but nothing that would have resulted in a bid at this point.

This piece is, I dare say, not as rare as the Black Diamond but possibly more rare than the Camelback. Let me get my Nomex suit on. OK, fire away.

While I normally don't try to waste time in rebutting Mr. Rowland, and his continual, troll-like posts and responses, I deemed this time worthy of spending the $1.60 to download some documents pertaining to the lawsuit. In particular, I looked at the plaintiff's Complaint and Amended Complaint. If anyone is interested, let me know through a PM, and I can send you the documents.

Specifically, though, the R&LHS is looking for three specific points of "relief" from the suit. They are:

1. Order making St. Louis County adhere to the loan agreement and return the locomotive;
2. Order requiring St. Louis County to return the locomotive (pretty much the same as above, just based on a different legal theory);
3. Unspecified damages for wrongful detention of the locomotive (unclear as to what this would be. R&LHS would have to prove some sort of damage from not being able to have the locomotive)

As I have pointed out before, and before, R&LHS is not arguing that St. Louis County has to return the locomotive in OPERATING condition, nor are they seeking it in their suit.

It would be interesting to know who the founding members of the Lackawanna Chapter of the R&LHS were/are and if any of them are posters in this thread.

It almost seems as though the Lackawanna Chapter was founded with the express intent of retrieving the 952.
