Jim Gunning has posted some photos from the Heber Valley's winter photo special:
A great deal of work has been done on the line's freight cars, including a complete repaint of their wooden box car and tank car. The train looks fantastic. A tip of the hat to Craig, Mike, and the entire Heber staff. JAC

Awsome pictures. Great looking train. With UP wanting $ from model makers using their trademark, does a museum have any problems with the UP name on htreir equipment? Dave |

Dave When I was last in Heber (2001), I discussed this with someone (can't remember). At that time, the trademark issues were split - John Bromley handled the relationship with non-profits, and a sports marketing firm in NYC handled the for-profit side. I remember that Heber approached UP, who gave them permission to letter no. 618 as it is. But UP requested that the ex-UP caboose not be lettered UP, on the off-chance of some caboose-related incident that might lead to someone seeking deep pockets. Since then, UP's trademark enforcement program has changed a bit. But as long as an organization like HVR applies for the license, I can't imagine there is any issue. And since they aren't manufacturing UP-branded merchandise, my understanding is that no money would change hands. JAC |

Then click on the "licensee application" link and choose the appropriate application: either Model RR manufacturer, Non-profit, or All others. If the last, reach for your wallet. |

I was always under the impression that when UP donated the locomotive to the State of Utah back in the 50's, there was a stipulation that the locomotive remain lettered for UP and "preserved". (Meaning, it would be wrong to renumber the locomotive and letter it "Heber Valley Railroad". I could be wrong on this, though.) The State still owns the locomotive. 618 was repainted in 2004 and the lettering was redone according to UP's lettering guidelines from the late 30's. (Well, it may not be accurate down to the 1/32nd inch, but we did the best we could.) It looks pretty much like it did when it was put in the State Fairgrounds. In early 2002, just before the Winter Games, Heber's NW2 No. 1011 was repainted from the UP Yellow-and-Grey scheme to it's 1940's livery of black with yellow lettering. While the locomotive is still lettered as Union Pacific, I'm sure the colors don't instantly tell people that. Edit: I looked at UP's license application form for Non-Profits. While the majority of the form deals with UP-branded merchandise (shirts, hats, etc.), there is a question down at the bottom that simply says, "Do you have UP branded equipment on display? Yes or No" It seems very non-profit friendly in that there's no fee for use of trademarks. Kinda funny when you think about it, though... they donate the equipment to us, and then they want to know if it has their name on it. - Mike Lewis |

Mike, The 618 was donated for display at the Utah State Fair Park. When it was no longer wanted there, it was given to the Promontory Chapter, NRHS, who leased it to the Wasatch Mountain Railway (Heber Creeper) for a very modest fee. After the Heber Creeper folded there was some difficulty with the previous owner so the Promontory Chapter, NRHS, donated the 618 and the little Davenport locomotive to the State of Utah for use on the newly formed Heber Valley Historic Railroad. There were some stipulations when the 618 was given to the Promontory Chapter, NRHS, I don't remember lettering being one of them. The 618 has always been lettered "Union Pacific". |
