As long as it's an active railroad operation, the state will HAVE to accomodate the railroad. (See City of Creede federal court ruling). Federal statute supercedes all state and local zoning and condemnation rules. A lot of state and locals just assume they can do whatever they please.

In this case the actual ROW and tracks are owned by the state. The Walkersville Southern leases the tracks from the state. -- Ray
