We appreciate your support and I'm sure it made a difference in the decision. The 20-page decision includes very strongly supportive Findings and Conclusions (visit our web site to read it). Unfortunately, the woman who has being trying to stop pretty much all development at the Northwest Railway Museum has filed an appeal, the third involving permits for this project.

Her attorney has presented three primary arguments:

1) The Northwest Railway Museum has failed to prove that the proposed development is either a stand-alone museum or an adjunct to an existing museum.
2) The application materials fail to prove that no harm will be done to adjacent wetlands.
3) The project concept violates numerous policies and objectives of the City of Snoqualmie's Comprehensive Plan.

What does this mean? The closed-record appeal will be heard by Snoqualmie's City Council in the coming weeks. Our application is strong and will almost certainly survive the challenge. But it will delay the project (again) and cost thousands more in legal fees.

One of the "tricks" pulled on us after we lost a court case (federal court and the opposition outsourced some very expensive lawyers ... we are talking combined legal fees of almost a million) was that we were required to pay the legal fees of the winner in addition to court costs. Do you think that that would or could apply in this case. It sure would help last ditch weak case appealers rethink their moves.

In your jurisdiction is there a point where the appellant has to post a bond to protect the other party (Your Museum) from irreparable harm by delay in the process?

The gal that has been pursuing this is married to a retired physician. Everything we've seen so far suggests cost is no object. As far as we can tell, sheÂ’s an octogenarian that is just plain unhappy with the world around her.

The appeal process here in Snoqualmie does not require a bond to be posted and there are no legitimate grounds for lawsuit against her.
