 Post subject: Nevada Northern Lawsuit

The Nevada Northern is fighting this lawsuit vigorously. In December, we opened escrow ($225,000) with LA and are working on final sale documents. We have already raised the money to complete the sale.

What the lawsuit does is take time, effort, energy and money away from our other projects. As the lawsuit winds its way through the legal system, I will keep all of you posted as to its status. Of course in the American legal system itÂ’s not over until itÂ’s over. We will just have to wait and see.

On a more positive note, we are having a couple of photo shoots in February. The first is the annual Steam Spectacle February 6, 7, & 8. Carl Franz is organizing the second shoot and it is February 10, 11, and 12. Contact me off line if you would like more details.

good luck. I found from experience that right beats might - but - it can be VERY expensive and many years.

One sad and sobering fact. A&K has gotten real good at this scam over the years, just ask regulatory agencies in Kansas, Missouri and Texas among other states. And the poor people who were taken in thinking they were investing in a real short line operation that was nothing more than a front for a scrap and real estate sale operation.

hopefully that past will follow A & K in this venture and haunt them. As communications become more "real time" it becomes harder to pull off these "bait & switch" operations.

Wouldn't it be possible to countersue these bozos and at least recover the legal costs?

Depends on NV law, on which I am far from an expert. But in general, to recover legal fees one must prove that a lawsuit was filed for a fraudulent purpose. Very tough to do. But while doing this, guess who continues to accumulate billable hours? Right! Lawyers!

I wouldn't hold my breath. Although their strategy is abhorent to our community (Rail Pres.), as a business model, it seems to have a lot of merit. The creative management of A & K have come up with a real money maker. I do believe it crosses the line when turning a buck overrides the alternative potential benefits to a community with a struggling economy. Even with a successful history of enacting their business philosphy, some ventures require good faith judgment on the part of management. That begs the question, "What ethics do we use in determining an acquisition or de-accession or adaptive reuse of the artifacts entrusted to us?" What is the greater use of the resources?
