 Post subject: UP Parody (or truth?)

I received this from a friend this morning. My company ships with UP so my buddy's in logistics really got a kick out of it.

It works to the tune of "I've been workin' on the railroad"

One that everyone can see
'Cause we're Usually Parked on sidings
That's why we're called U.P.

We're a million tons of cargo
Just a rottin' in the sun
We're the Union Pacific
And our meltdown's just begun

From the plugged up yard in Roseville
To our mainline filled with cars
It's a big congested mess
Like a railroad version of SARS

We're a thousand wheels of freight train
All being held for power
We're the Union Pacific
Makin' half a mile an hour

Bound from Omaha to Portland
Our customers are in luck
'Cause we're setting out their cargos
To load it all on trucks

With Amtrak stuck in Oakland
And in Denver and L.A.
We're the Union Pacific
And you're not gonna move today

From the Valley to Dunsmuir
We are runnin' out of crews
But we'll deliver your great cargo
'Cause we're usin' DPU's

We're much safer and efficient
All thanks to remote control
We're the Union Pacifc
Our bean counters say it's so

With our copyrighted emblem
We're gonna make 'em bleed

Actually, it is this type of material that encourages railroads, and other businesses, to protect their logos, service marks, trademarks, etc.

I seem to remember it was in the mid 1980s when someone created a caricature of the old Chessie System logo (the sleeping kitten) that was a bit "offensive." It caused Chessie to start requiring their prior approval of any re-use of their logo.

It should be noted that before this, railroads customarily provided financial support to some model railroad manufacturers to offset the cost of making model dies of their logos! By the way, this subject was covered in a front-page article in the Wall Street Journal in the mid-1980s -- Ray

Please explain why UP's utter failure at customer service (and many angry Forture 100 customers) is ok, but an attempt to react to this failure is not?

Actually, this is arguably a parody, which is a form of protected speach. The railroads, along with several hundred other corporations, act to protect their copyrights because failing to police them and failing to prevent dilution of them amounts to their invalidation. Since copyright law is driven by legislators who take huge donations from Disney, Warner Bros, etc etc, I wouldn't expect it to favor the little guy any time soon.

Yeah. I should be quiet. If it gets out I work in the legal field lots of folks around here will blame me for everything bad that has happened in the excursion industry in the last 20 years, denounce me as the anti-christ, and form a mob to burn me at the stake.

OK, folks, back to railway preservation if you please. If we want to continue this topic I'd say lets tie it to some hard information about how or whther UP's policy affects museums or tourist roads. Otherwise, the topic is more appropriate for Trainorders et al.
