Dave Crosby is correct. The lawsuit has been brought by the the Lackawanna Ch. of the R&LHS vs. the MOT in St.Louis. Should the Chapter prevail I can tell you that Steamtown is the LAST place they'd want it to end up.

I believe they have developed extensive plans for the engines renovation should they prevail, with the work being done by a shop with a good track record.

Hopefully the court will hear the case soon so all involved can get on with it!!

Is there any place online or otherwise to follow the proceedings of the case?
I'd sure like to know what will become of that engine. Another case of DLW that should be allowed to run or at least be cosmetically restored.
A simply beautiful engine. How did she end up so far from home anyway?

Well I was told this by a friend long ago. but this is what he said " St.Louis. railroad museum was just starting out they were looking for locomotive of all kinds and makes , models for this museum. So the EL sent them a camel back out of their fleet of 100's . The Reading Company sent then their fully restored Black diamond inspection locomotive built in the 1800's and other railroad companies did the same.

Actually,

The DL&W wasn't the one donating. The unit was donated by the DL&W to the R&LHS in 1939. In 1953 (if I'm not mistaken) the R&LHS sent the engine to St Louis on "Permanent Loan", which is a vague term. The original loan agreement is where most of the legal wrangling is based. I've never actually seen a copy of this original loan agreement, though it is oft quoted by different sources.

The R&LHS group that is trying to assume possession of the engine today is a chapter that was organized a decade or so ago with this as aquisition their primary goal. They have more recently begun work on the Delaware Water Gap Station. This chapter did not exist when the 952 was orginally donated.

The EL did not donate the engine, as the company would not exist for several more years.

Going back a few posts, a real HISTORIAN would know, or be able to quickly find out, that the Erie-Lackawanna didn't exist until 1960, years after all of the roads got rid of their last camelbacks. That 1960 date is 21 years after the donation of the 952 by the DL&W. Not even close-

Lets see now- historian, underwater archeologist, musicologist, pressure vessel expert, etc., the man's credentials are astounding-

I don't recall any bridges like the one on the post above on the present Black River, so I suspect the CNJ Chester Branch. Plus, I never heard of the 565 being steamed up at the Flemington, Ringoes, Lambertville location.

Ok, I've been quiet on this high jacking of my post for a work crew on 565. Here are the facts about 565 she is at Steamtown, she will be restored and be a beautiful center piece at Steamtown, She WILL NOT STEAM again..........why? For the same reason Strasburg hasn't fixed their Camelback or 972---------money and manpower! I don't see you guys getting on Mr. Anderson and his crew for not fixing the camelback!
We are finally getting things moving and I have my post high jacked on the argument of another camelback that is stuck in the legal system. Come on fellas let's focus on the task at hand restore what's out there and who cares if it steams or not. I don't care if it's an American, Canadian, or Mexican let’s just be happy we have steamers out there.

Sorry for the blow up but I'm here for one thing help Steamtown or whoever wants my help.

" Gentlemen,

I must apologize for doing this but with me leaving in a few short weeks my younger son is in a championship baseball game that had to be moved to Sunday. So I’m not going to be able to come up and give you a great turn-over on this project, I apologize again. I hope you understand that family comes first especially with the way the situation is for me. I encourage you all still to go up.

Bruce Mowbray, in the CC box, is a shop boss at Steamtown and has been an awesome help and great person all around. He is excited, like most of the shop, about getting 565 back to her former glory. All the parts are by the engine and in the room just in front. We have 3 bins full of stuff. Some we are sure don’t go so you can take that back to the scrap dock (It is a nick name). Pat who Leo has been in contact with can help with getting you into the basement where there may be some more parts. Justin you have been there too. Some of the parts will have to be made. The cow catcher and front of the boiler are located in the bay next to the tender. The boiler jacket is on the other side of 759. The doors and windows are in the parts room off the room where the bins are. As you come into the room look to your left on the shelves, you will see red doors about 5-6 feet on a shelf those are for 565. Also in that same room is a loft, the headlight is there.

Bruce wants to get her on the pit to re-install the journals but we need the wheel lift to do that. So we have to wait until the contractor gets that fixed. I suggest you guys concentrate on getting the pilot truck ready to go back in. Also sandblast the journals for the front driver and you are going to need to make the piece that holds the journal in place. We have one so to make a copy should be easy. It’s in the bins. It’s about 2 feet long, 2 inches thick and about 4 inches wide. If get that done over the next several months, may look at the tender as an easy kill to get finished. To me it looks in very good condition, except for the rotten wood on the ends and that ugly oil tank.

Again I do apologize for this but my family comes first. Thanks for helping and good luck. I will stay in contact with you guys while I’m over there. I should be able to get with you thru RYPN or Railfan.net.

Parts Still Missing:

The pilot truck pin.

The steps for the front of the tender, they may be in a crate up on the hill. It’s a big metal box just to the left of the stacks of sheet metal. They are under some couples in that crate.

Steve.

If theres any one eles wants to come and help us this Sunday we are meeting at 9:30 AM. next the the Big Boy. The more help we get the better it is for 565 to look like her self once more.
Thank you,
Len.

Does this letter, which appears to be intended as an internal communication within the group which is working on 565, really need to be posted by a third party when the originator is a regular participant and is quite capable of posting it himself?

Trainlawyer,
Do you realize the man is busy with getting ready to go over seas, to defend our country. All I'm trying to do is get more people involved to help the cause to Cosmedic restore this historical locomotive.

Leonard.

Yes Leonard, I do. The publication of correspondence beyond its intended recipients without consent is at best exceedingly discourteous. Anybody who has actually been following the project has been aware for at least a few weeks. Quite frankly, if anybody is going to disseminate that news it should be him - not you.

You could have accomplished that by cleaning up your second sentence.

Incidentally, I consider it extremely offensive that you addressed another veteran Non-Commissioned Officer as follows:
Quote:
I can read that your a smart ??? !
And I bet I'm not the only one that feels that way.

because after several polite hints you refused to get his name right.

Trainlawyer,
I'll tell you what if you don't like seeing me on here, then don't have to watch this board, the PRR b-8 locomotive is in deed in that quarrie and I know many of locals in that area that can tell you the same information. The state of Pennsylvina plulled the plug on the project because they know for a fact it's down there. I was told by the man who was charge of the quarrie, that the locomotive is down there and when the state bought the quarrie in the early 1970's, that they drained the quarrie to document whats there.

I'm suddenly having horrible flashbacks to my stint as the sole moderator of the Chaski Railfan forum.

And the worst part of it is, it probably involves some of the very same cast of characters, to boot. <:-/
