The 4-year-old boy who fell out of a train window last week did not fall because the train car was rocking, said Cliff Welz, operations manager of the Upper Hudson River Railroad.

Bet the parents sue anyway. Some ambulance chaser will convince them that they have a good suit. Of course the attorney will take the usual 40-50%. And then the insurance will go through the roof, maybe even enough to force the railroad to shut down. It is a shame the courts don't make people responsible for thier own actions.

Later!

The railroad plans to make changes to its windows to keep this from happening again. A lawyer can use this to prove that the railroad did not do all that they could have to safeguard the public on its trains.
