Good Morning,
Frisco, I am not demanding to know about anyone's confidential agreements. I am asking if one is in place that is all. Second there has been an implication by the guys in Maine that the locomotive must stay in Maine for legal reasons.........I have read the City of Waterville call for proposals..........no where does it say the locomotive must stay in Maine..........if that is indeed the case than how come only the Maine group was made privy to that part of a public RFP call???

While really having no proverbial dog in this fight....

... it occurs to me that this many years after the fact, some condition of donation/display that mandates that the loco "must stay on MEC rails" is fairly unenforceable in 2013. Is there anyone left, in the corporate remnants of Maine Central/Pan Am Railways/whoever they are today that 1) cares enough about this loco's fate or location, and 2) cares enough to initiate legal action thereof regarding said agreement? (We're talking anyone with a realistic claim to being able to initiate such action, not someone filing yet another STB petition to start some railroad using this loco and some right-of-way lord-knows-where-this-time-around....)

Obviously, the idea of such a covenant is to keep the loco from being sold to hang from a casino ceiling, from being scrapped in a World War Five scrap drive, etc. But, sheesh, if anyone cared that much, wouldn't they have told the city to surrender the locomotive already simply based on its neglected condition and potential hazard? Has any organization ever reclaimed its display loco or car based on proscribed situations post-donation?

ADM-to answer your question (a good point, BTW)-the only example I can recall in recent memory concerned Atlanta and West Point 290. IIRC, it was viewed as a potential candidate to become a "kitbashed" (my term) Southern Railway Ps-4 and operate on Southern steam excursions. However, CSX got wind of that and put an end to that.

Yet again, goating people for information is not going to get you what you are asking for. As I have said in other posts, if you are that concerned about the RFP process then call the City. All they have released to the media is that there were 6 groups who put in proposals. Nothing else has been released. So that being said, they are the ones who can give you the yes or no.....not me. I do not have the authority to do so.

Good to know. I will say no more on the matter since we can't keep the speculation to a minimum, and will not be preasured to answer questions that no one other than the City of Waterville is able to respond to. Also, it is very forward and out of sorts to accuse people of "stone walling" other peoples efforts. Especially when one has not a clue in the world what they are talking about. Only people doing the "stone walling" are the people putting undue pressue on the process by trying to circomvent it with the inability to comprehend the word no or the phrase I can't say.

Implying that a agreement is in place plus stating some legal nonsense is in place is a pretty good description of stone walling. In my book.

There is no agreement in place with anybody. The City is exploring an alternative to the proposals recieved in response to the RFP.

It seems like everyone is so caught up in this argument. Does anyone know how long the 470 is? I was looking back at some video I shot at the roundhouse and the FL9 fits on with what I would estimate as about 6 feet of clearance on each end. Hope she fits!

I agree this has degenerated into a pissing match. Not where I want to be.

There is no agreement in place is exactly what I was trying to say. My apologies that I do not articulate thoughts that well.
