Indeed, an expensive learning experience.
(1) Get ALL agreements IN WRITING.
(2) Be sure every party to the agreement UNDERSTANDS what's in the agreement.
(3) Don't sign any paper UNLESS you COMPLETELY UNDERSTAND what's in the paper.
(4) Have an attorney EXPLAIN in plain English what the agreement says and really means.
(5) If you don't have your OWN attorney, HIRE one who is independent of the other party's attorney. It will be money well spent. Don't depend on the other party's attorney to thoroughly explain the content of the document. Don't be afraid to wait until YOUR attorney is available to review and explain the document to you. Don't rush into signing any document.
(6) Remember that times change. The well-meaning benefactor who joined your organization long ago might have had life-altering experiences, such as illnesses, that may necessitate a change in his/her end-of-life plans.
