Troubles in North Carolina

I recieved the following in an e-mail from a yahoo group that I belong to. Anyone know any more about this situation?

The Black Mountain - Yancey - Toe River railroad operators in Micaville, North Carolina are having trouble with a deveoloper who wants their property that the railroad is on, the developer has talked the locals into bringing in a bulldozer and pushing a section of their track into the river and setting fire to the wooden bents on their steel railroad bridge.

If you are connected to the "general rail system", perhaps the Feds should be given a call, if locals won't stop it-sounds like restraint of interstate commerce.

To whom does the R-O-W belong? IF it's the RR's, it's a simple case of the developer guilt of trespassing, vandalism, etc etc.

Anyone know what group/operation this might be? All I know is that it's supposedly some kind of tourist operation, but I can't find anything about it, not even a name, doing Google searches.

What little I've heard about this is that the people running motorcars on the line went to the sheriff or other local authorities, who didn't do much about it. Perhaps its one oc those cases where the developer is related to someone in law enforcement. I'm not sure who owns the property now. It once belonged to the Clinchfield RR (Clinchfield No. 1 and the 4-6-0 at the Casey Jones museum were the last steamers there), and I think the mica company bought it in the 1950s to preserve rail service to their plant. There was a brief attempt to start excursions in the 1960s, using an ex-BEDT 0-6-0T. I'm not sure if the present group has a name, 501c3 status, etc.., or is just loosely organized.
