In the Article of the Court Case, The Owner of EBTPA claims that the Property is a "Walking Museum"

IF SO, then that means we all can walk from level grade crossing on North Jefferson Street in Mount Union in a North Western direct paralleling the Tracks to the Norfolk Southern Interchange on July 8th between 1p and 5p to Witness the Union Pacific Big Boy 4014 Steam through Mount Union, PA

there is about a 500ft open stretch there to watch it pass by

Do Note, Big Boy will (Probably) be on Track 2

Remember People to Stay 25ft back from the Tracks

Nobody with a lick of common sense takes that "walking museum" claim seriously.

Of course, so far the online videos of the entire "Coast to Coast" UP Big Boy tour have seen a surprising number of people lacking "a lick of common sense" in the first place, so maybe they'll fit right in.

You're correct but you missed my point. Lane cannot sell his nonprofit. He can dissolve and donate any proceeds, or merge it into another nonprofit including all assets, liabilities and cash, not profiting either way, or go bankrupt.

Did you mean Salone here?

You're assuming way too much here. If you look at the online aerial photos of the area, the walking path starts at Washington Street and heads southwest from there.

In a notrthwestery direction from Washington Street there is no path and it is strictly railroad property. There is also an access gate installed by Norfolk Southern. There is no open stretch to view the Big Boy from public-accessible property. I understand that people are willing to overlook many things in order to veiew the Big Boy, but I would also strongly discourage willfully trespassing, which is what it sounds like you're doing.

The movement of the Big Boy through this area is occurring during a weekday and this is an active area with regular activity. The interchange tracks here are also used by Norfolk Southern as an off-mainline spur for storage of MOW equipment, etc. I believe NS would care more about the security of its facilities than your desire to have an open spot to view the Big Boy which could be better viewed elsewhere along the Norfolk Southern Pittsburgh Line.

I refer back to the "common sense" theme.

Inasmuch as we have seen many controversial judicial decisions of late (mostly of Federal District judges "sticking it to Trump"), I sincerely expect this preposterous claim to be literally laughed at by the courts.

And I am disinclined to take the suggestions of someone whose grammar education is still a work in progress.

It's not known as Mt. Union Connecting, it's East Broad Top Connecting in the NS guide:

Mount Union Connecting Railroad (MUCR) was Alan Levin and Rob Mangels.

Here's a December 2022 Facebook post by Rob Mangels:
Quote:
As an owner of the Mount Union Connecting Railroad along with Alan Levin, our efforts to restore operations to MU were in progress when Alan died and a legal battle was lost causing our operation to come to a halt. We rebuilt track, the engine house, and the loading dock in town and did receive revenue cars . I have hundreds of pages of documentation that will eventually be passed on to the EBT archives so the era of MUCRR shall be accurately documented. We are not affiliated with anything Mr. Salone did or is doing now, although there are stories to be told some day of the 10 years or so we were affiliated with the MU operations. Alan would be ecstatic to see what is happening to the EBT, as am I, but very disappointed in what is happening on the Standard Gauge portion in MU.

Further down in that FB thread Christopher Coleman stated that "MUCR was founded in 1998 and lost it's lease after the 2009 [Larry Salone] EBTPA lease of the the EBT."

Always found the name of Salone's organization rather ironic, since they did very little in the way of preservation. Like the treatment of the standard-gauge 0-6-0.

Cool Upcoming FB documentary posts !
As many of you may know, back a few years ago our team was fortunate enough to be chosen for the lead consultants/contractor to manage the historic move/logistics of the famous East Broad Top Railroad #3 Baldwin Steam locomotive from Mt. Union, PA to Red Bay, AL.
We have always been known to love a challenge. But this one was a very long and daunting task.
As one can imagine, there is an insane amount of planning and balancing that has to take place in a story like we will be sharing over the next several months with our followers and friends.
We traveled to PA several times over the span of approximately 2 years to put this project together. We documented this journey with tons of photos and videos, and will share our experiences and information on the locomotive and tender that we discovered.
This will be approximately 6-8 part/posts over next several months. Placed at random times/dates.
Note: We had no part in the cosmetic restoration work on the locomotive or the first removal from the building it was parked in since 1956.
However, we did have to remove numerous items in order to secure and transport, and then replace them back once unit was set up in Red Bay.
We will be happy to share ALL the FACTS with everyone, answer questions, and clarify so many rumors.
Please follow this journey that critics said would be impossible to do. We were happy to be a part of this historic preservation project."

Sort of reminds me of a kidnapping ransom note; again, I can't see any reason for moving this engine to the South other than to keep the EBTF from having it, i.e. spite.

In only vaguely related news, the FB page for the Juniata & Aughwick RR (yes, there is one) announced that the RR has acquired and relocated to Mount Union the former PRR/Amtrak N5 caboose (or "cabin car" to PRR pedants) that had been in Southern New Jersey threatened with scrapping along with the Alco FA/FB shells that ultimately were scrapped.

Car in question is former Amtrak 14008, reportedly ex-PC 19023, exx-PRR 479715. Cupola had to be removed for trucking.
